Privacy Policy

This Privacy Policy explains how BIOGENEX LLC (“BIOGENEX,” “we,” “us”) collects, uses, shares and protects personal information when you visit biogenexct.com, submit a form, call us, receive text messages from us, or use the services linked from this website.

1. Information we collect

Information you give us. When you request a free Lab trial, submit a medication refill request, book a consultation, call, email or text us, we collect what you provide. This can include your name, email address, phone number, the services you are interested in, the clinician you see, medications you are requesting, and any notes you choose to include.

Information collected automatically. When you visit the website, our hosting provider and analytics tools collect technical information such as your IP address, browser and device type, pages viewed, links clicked, referring website and approximate location derived from your IP address. See Cookies & analytics.

Information from scheduling and care platforms. Appointments, intake forms, clinical records and patient messages are handled inside our patient portal and electronic health record (OptiMantra) rather than on this website. See Health information.

2. How we use your information

  • To respond to inquiries, schedule appointments and set up Lab trials and memberships
  • To process medication refill requests and coordinate your care with your clinician
  • To send appointment reminders, service updates and other communications you have agreed to receive, including text messages
  • To process payments and manage memberships, packages and credits
  • To operate, secure and improve the website and understand which content is useful
  • To comply with legal, regulatory and licensing obligations and to protect our rights

We do not sell personal information. We do not use personal information for targeted advertising, and we do not use personal information to train large language models.

3. Text messaging (SMS) program

By providing your mobile number to BIOGENEX through a website form, our patient portal, an intake form, in person or by phone, and agreeing to receive texts, you consent to receive text messages from BIOGENEX at that number. Messages may be sent using automated technology.

Types of messages. Appointment confirmations and reminders, scheduling and rescheduling, Lab trial and session coordination, medication refill status and pickup or shipping updates, requests to log in to the patient portal, membership and billing notices, and responses to questions you send us. If you separately opt in to promotional messages, we may also send occasional offers and clinic news.

Frequency. Message frequency varies based on your appointments, care and account activity.

Cost. Message and data rates may apply according to your mobile carrier plan. BIOGENEX does not charge for text messages.

Opting out. Reply STOP to any message to stop receiving texts. You will receive one message confirming your opt-out. Reply START to resubscribe. Opting out of texts does not affect your care, and we will continue to reach you by phone, email or the patient portal.

Help. Reply HELP for assistance, call 959-204-5375 or email info@biogenexct.com.

Consent is not a condition of purchase. You do not need to agree to receive text messages to become a patient or member or to purchase any service.

Protecting your health information by text. Text messaging is not a fully secure channel. We keep clinical details out of text messages whenever possible and direct you to the patient portal for lab results and clinical communication. Please do not text sensitive medical information or emergencies. If you have a medical emergency, call 911.

Your mobile information is never shared for marketing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from all information-sharing described in this policy and will not be shared with any third party. Information may be shared only with the service providers that deliver our text messages on our behalf.

Carriers are not liable for delayed or undelivered messages.

4. How we share information

We share personal information only as needed to run the practice and provide your services, and only with:

  • Service providers who work on our behalf, such as website hosting and form handling (Netlify), our patient portal and electronic health record (OptiMantra), text messaging and phone providers, payment processors, website analytics (Google Analytics and Microsoft Clarity) and email providers
  • Clinical partners involved in your care when you use them, such as laboratories, licensed pharmacies and our supplement dispensary (Fullscript)
  • Legal and safety recipients when required by law, subpoena or court order, or to protect the rights, safety or property of patients, BIOGENEX or others
  • A successor in the event of a merger, sale or transfer of the practice, subject to this policy

Our Members Only Community is hosted on Skool, and our social media pages are hosted by Instagram and Facebook. Information you post or share on those platforms is governed by their own privacy policies.

5. Health information

Health information that becomes part of your medical record is protected under applicable federal and Connecticut health privacy laws and is handled through our patient portal and electronic health record. Those protections apply in addition to this website policy.

Public website forms are meant for scheduling, trial requests and refill requests. Please do not include detailed medical history in website forms. For lab results, symptoms and clinical questions, use the patient portal.

Where Connecticut law treats information you share with us as consumer health data or sensitive data, we process it only as reasonably necessary to provide the services you request, with your consent where the law requires it, and we never sell it.

6. Cookies & analytics

We use Google Analytics and Microsoft Clarity to understand how visitors use the website. These tools use cookies and similar technologies to record page visits, clicks, scrolling and session activity. Clarity may record how a page is navigated, with form entries masked. We also use your browser’s session storage to remember whether you have closed our Lab trial pop-up.

You can block or delete cookies in your browser settings, and you can opt out of Google Analytics with the Google Analytics opt-out browser add-on. We treat a Global Privacy Control signal from your browser as a request to opt out of any sale of personal data or targeted advertising.

7. Your privacy rights

Depending on where you live, including under the Connecticut Data Privacy Act, you may have the right to:

  • Confirm whether we process your personal data and access it
  • Correct inaccurate personal data
  • Delete personal data you provided or that we obtained about you
  • Obtain a portable copy of your personal data
  • Opt out of the sale of personal data, targeted advertising and certain profiling
  • Withdraw consent you gave for us to process sensitive data

How to make a request. Email info@biogenexct.com with the subject “Privacy Request” or call 959-204-5375. We will verify your identity before acting on a request and respond within 45 days. Some information must be kept to meet medical record retention and other legal requirements, and we will tell you if that applies.

Appeals. If we decline your request, you may appeal by replying to our decision with the subject “Privacy Appeal.” We will respond within 60 days. If you are not satisfied with the outcome, you may contact the Connecticut Attorney General.

We will not discriminate against you for exercising any of these rights.

8. Security & retention

We use administrative, technical and physical safeguards appropriate to the information we handle, including encrypted connections to this website and access controls on our systems. No method of transmission or storage is completely secure. We keep personal information only as long as needed for the purposes described here, and medical records for the periods required by law.

9. Children

This website is intended for adults. We do not knowingly collect personal information online from anyone under 18. Care for minors, when offered, is arranged directly with a parent or guardian.

10. Changes to this policy
